1. Acceptance of Terms
By accessing and using the TuteOS website and platform, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
TuteOS is a comprehensive coaching institute management operating system. We provide software-as-a-service (SaaS) tools to manage students, attendance, fees, exams, and communications. The service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of the service at any time.
3. User Accounts
To use most features of TuteOS, you must register for an account. You must provide accurate and complete information and keep your account information updated. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify us immediately of any breach of security or unauthorized use of your account.
4. Subscription Plans and Payments
TuteOS offers various subscription plans. By selecting a plan, you agree to pay TuteOS the monthly or annual subscription fees indicated for that service. Payments will be charged on a pre-pay basis on the day you sign up for a plan and will cover the use of that service for a monthly or annual subscription period as indicated. All payments are processed securely through Razorpay.
5. User Responsibilities
You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the service. You are responsible for the data you input into the system and for ensuring that you have the right to collect and process such data (including student information) in compliance with applicable laws.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of TuteOS and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of TuteOS.
7. Service Availability
We strive to ensure that TuteOS is available 24/7. However, we do not guarantee uninterrupted access to the platform. We may occasionally need to schedule downtime for maintenance or upgrades, and we will do our best to notify you in advance.
8. Account Suspension and Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
9. Limitation of Liability
In no event shall TuteOS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
